General Terms and Conditions of Sale (GTCS)

1. Purpose
These General Terms and Conditions of Sale (GTCS) are intended to define the rights and obligations of the parties in the context of the online sale of collectible products offered by MLM DISTRIBUTION SAS via the website www.mlmdist.com (hereinafter referred to as "the Website"). By accessing the Website and placing an order, the buyer (hereinafter referred to as "the Client") unreservedly accepts these GTCS. They take precedence over any other document issued by the Client or third parties.
2. Products
2.1 Product Description
The products offered for sale on the website www.mlmdist.com are exclusive and made to order. Each product is manufactured within the limits of the available quantities of referenced car models worldwide. This means that the products are not kept in stock, but are produced specifically for each order placed by the owning Client.
2.2 Availability
The products are made to order and in limited quantities, based on the availability of car models worldwide. This production method guarantees the exclusivity of each product. Due to the nature of made-to-order production, manufacturing times may vary. The Client will be informed of the estimated timeframes on the product page or, if not, during communications after the order is placed.
3. Prices
3.1 Product Prices
Product prices are indicated in euros (€) for clients residing in Europe and in US dollars ($) for clients in the rest of the world. These prices include all taxes (VAT included), unless otherwise stated. Delivery charges are not included and will be added to the total amount of the order before final confirmation.
3.2 Price Changes
MLM DISTRIBUTION SAS reserves the right to modify its prices at any time. However, products will be invoiced based on the rates in effect at the time the order is confirmed by the Client.
3.3 Customs Duties and Taxes
For international orders, customs duties or other local taxes may be payable upon arrival of the parcel in the Client’s country. These charges, which do not fall under the responsibility of MLM DISTRIBUTION SAS, shall be borne by the Client in accordance with Incoterm DAP (Delivered At Place).
4. Order
4.1 Ordering Process
The Client selects the products of their choice and adds them to their virtual cart. They can review and correct the contents of their cart at any time. After confirming the cart, the Client must identify themselves or create an account on the Website, provide delivery information, and choose a payment method.
4.2 Order Confirmation
Order confirmation by the Client implies acceptance of these GTCS. The sale will only be considered final upon receipt of full payment by MLM DISTRIBUTION SAS. An order confirmation will be sent to the Client by email.
4.3 Order Refusal
MLM DISTRIBUTION SAS reserves the right to refuse any order for legitimate reasons, such as prior payment issues, suspected fraud, or an abnormal order in terms of quantity or frequency.
5. Payment
5.1 Payment Terms
Payment of the total price (product and shipping fees) is required at the time of order. The Client may make payment via the following method: SEPA bank transfer.
5.2 Non-Payment
In case of non-payment, the order will not be shipped. MLM DISTRIBUTION SAS reserves the right to suspend or cancel any order in case of non-payment or payment processing issues.
5.3 Invoicing
An electronic invoice will be issued and sent to the Client by email upon payment confirmation. The Client may also access their invoice by logging into their account on the Website.
6. Delivery
6.1 Delivery Areas
Products are delivered internationally to the address indicated by the Client when placing the order. MLM DISTRIBUTION SAS shall not be held liable for incorrect or incomplete addresses provided by the Client.
6.2 Carrier
Products ordered on the website www.mlmdist.com are shipped by UPS or FedEx. These trusted service providers are known for their reliability and fast international delivery times. A tracking number will be provided to the Client to allow real-time tracking of the package.
6.3 Delivery Times
As products are made to order, delivery times include the production time and vary depending on the specifics of each order, particularly if VIN number engraving is requested. Estimated delivery times will be communicated to the Client at the time of order confirmation. While MLM DISTRIBUTION SAS strives to meet these deadlines, they may vary due to the complexity and availability of required materials and/or local logistical and customs conditions beyond our control.
6.4 Shipping Costs
Shipping costs are calculated based on the package weight, destination, and delivery method selected by the Client. These costs are added to the total order amount before final confirmation.
6.5 Receipt of Products
Upon receiving the package, it is the Client’s responsibility to check the condition of the packaging and the products. In case of damage or anomaly, the Client must file a claim with UPS and inform MLM DISTRIBUTION SAS within 48 hours in order to process the complaint.
7. Right of Withdrawal
7.1 Conditions of Exercise
In accordance with applicable legislation, the Client has a period of 14 days from receipt of the products to exercise their right of withdrawal, without having to justify any reason or pay penalties, except for return costs.
7.2 Return Procedures
The Client must notify their decision to withdraw in writing to MLM DISTRIBUTION SAS (by email or registered letter). Products must be returned in their original condition, unused, with all accessories, and in their original packaging, to the following address: MLM DISTRIBUTION SAS 25 BOULEVARD BEAUSITE 06400 CANNES Return costs are borne by the Client.
7.3 Refund
In case of withdrawal, MLM DISTRIBUTION SAS will refund the Client within 14 days following receipt of the returned products. The refund will be made using the same payment method used for the order, unless otherwise agreed between the parties.
8. Warranty and Claims
8.1 Legal Warranty
Collectible products sold on the Website benefit from the legal warranty of conformity (Articles L.217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). In case of non-conformity or hidden defect, the Client may request repair, replacement, or reimbursement of the product.
8.2 Claims
For any product-related claim, the Client is invited to contact the MLM DISTRIBUTION SAS customer service at the following address: contact@collectorcarplaques.com. A response will be provided as soon as possible.
8.3 Limitation of Liability
MLM DISTRIBUTION SAS shall not be held liable for indirect or consequential damages related to the purchase of a product on the Website. In any case, the liability of MLM DISTRIBUTION SAS is limited to the amount of the order.
9. Intellectual Property
9.1 Copyright
All elements of the Website (texts, images, graphics, logos, etc.) are the exclusive property of MLM DISTRIBUTION SAS or its Partners or Licensor. Any reproduction, representation, modification, publication, or adaptation of all or part of the elements of the Website, regardless of the means or process used, is prohibited without prior written authorization from MLM DISTRIBUTION SAS.
9.2 License of Use
The use of the Website does not confer any intellectual property rights to the Client over the elements of the Website. The Client is authorized to use these elements exclusively within the scope of Website use and for personal, non-commercial purposes.
10. Data Protection
10.1 Data Collection
Personal data collected during the order process are necessary for its processing. These data are treated confidentially and are not disclosed to third parties without the Client’s consent, except when necessary for order processing (e.g., carriers).
10.2 Client Rights
In accordance with applicable data protection regulations, the Client has the right to access, rectify, delete, and port their personal data, as well as the right to object to the processing of such data. 10.3 Data Security
MLM DISTRIBUTION SAS implements appropriate technical and organizational measures to protect the Client’s personal data from loss, unauthorized access, alteration, or disclosure.
11. Applicable Law and Jurisdiction
This contract, as well as any contractual relationship between the parties, is governed by French law. In case of dispute, only the court of jurisdiction of the registered office of MLM DISTRIBUTION SAS shall have competence.
